Terms of Service

These Terms of Service govern your access to and use of the Find Scrims service (the "Service"). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Eligibility and Accounts
You must be at least 14 years old to use the Service. Users under 18 must have parental or guardian consent. You are responsible for maintaining the confidentiality of your account and for all activity that occurs under it.

User Content and Public Information
You may share information such as profiles, team details, tryouts, messages, and contact requests. Some information is public by design (for example, public profiles and team listings). You are responsible for any information you choose to share, including its accuracy and legality.

Messaging and Contact Requests
The Service enables direct messages and contact requests between users. You agree to use these features respectfully and lawfully. You are solely responsible for your interactions and any content you send.

Message Attachments
The Service may allow you to upload and download files in messages. You are solely responsible for the files you upload, share, or download, including verifying safety, legality, and ownership rights before sharing or opening files. You agree not to upload, send, or distribute malicious code, harmful content, or files that violate law or third-party rights.

Connected Accounts and Third-Party Integrations
The Service lets you optionally link third-party accounts and services (including Twitch, YouTube, Discord, and public stats profiles). By connecting an account, you authorize us to access and use information from that provider as described in our Privacy Policy, such as verifying channel ownership, displaying linked identities, importing supported connections, and checking whether a linked channel is live. You are responsible for complying with each provider's terms and for disconnecting integrations you no longer want linked. We may modify or discontinue integrations at any time.

Prohibited Conduct
You agree not to:

Harass, threaten, impersonate, or abuse other users.
Scrape, harvest, or misuse personal information.
Attempt to gain unauthorized access to accounts, systems, or data.
Upload malware, spam, or otherwise interfere with the Service.
Violate any applicable laws or regulations.

Security and Responsibility
You accept full responsibility for how you use the Service and for any information you disclose. You agree not to misuse data accessed through the Service or attempt to hack or exploit the platform. You are solely responsible for any unlawful or harmful actions you take against the Service or other users.

Payments, Billing, and Auto-Renewal
Paid subscriptions are processed by third-party payment providers (such as Stripe). By purchasing a plan, you authorize us to charge the applicable fees and taxes. Subscriptions renew automatically at the then-current rate for your billing interval (monthly or annual, as selected) until you cancel. You can cancel renewal anytime in your billing portal or account settings; cancellation takes effect at the end of the current paid period unless stated otherwise at checkout. We may change subscription prices with advance notice where required by law. Refunds, if any, are described at checkout or in your billing portal.

Tournament Payments and User-to-User Transfers
Find Scrims may allow users to coordinate tournament entry fees, payouts, and other peer-to-peer payments. We do not custody funds for these transactions and are not a party to payment agreements between users. You are solely responsible for verifying counterparties, using trusted payment methods, and complying with applicable laws, tax rules, and platform policies. Always use caution when sending money to people you do not know.

Intellectual Property
The Service and its original content, features, and functionality are and will remain the exclusive property of Find Scrims and its licensors.

Use License
Find Scrims grants you a non-exclusive, non-transferable, limited license to access and use the Service for your personal, non-commercial use. You may not reproduce, distribute, or create derivative works from the Service without our permission.

Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind. We do not guarantee that the Service will be uninterrupted, secure, or error-free.

Limitation of Liability
To the maximum extent permitted by law, Find Scrims will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill arising from your use of the Service.

Indemnification
You agree to defend, indemnify, and hold harmless Find Scrims and its affiliates from any claims, damages, losses, and expenses arising out of your use of the Service or violation of these Terms.

Termination
We may suspend or terminate your access to the Service at any time for any reason, including violations of these Terms.

Changes to These Terms
We may update these Terms from time to time. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

Artificial Intelligence and Automated Features
Find Scrims does not currently provide generative artificial intelligence features that create content on your behalf. The Service may present automated suggestions (for example, scrim or team recommendations) based on profile and activity data. These outputs are informational only, may be incomplete or inaccurate, and do not constitute professional, legal, or competitive advice. You are solely responsible for decisions you make based on Service suggestions or automated indicators (including live-stream status). We may use automated systems to help enforce these Terms and protect users.

Dispute Resolution, Binding Arbitration, and Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Before filing a claim, you agree to contact us at info@findscrims.com and attempt to resolve the dispute informally for at least 30 days.

If informal resolution fails, you and Find Scrims agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, except that either party may bring an individual action in small claims court if it qualifies. The Federal Arbitration Act governs the interpretation and enforcement of this arbitration agreement.

Class action waiver: disputes must be brought only in an individual capacity, not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate claims or preside over any form of representative proceeding.

Jury trial waiver: you and Find Scrims waive any right to a jury trial for disputes covered by this section, to the fullest extent permitted by law.

Opt-out: you may opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing info@findscrims.com with subject line "Arbitration Opt-Out" and your account email. If you opt out, disputes will be resolved in state or federal courts located in California, and both parties consent to personal jurisdiction there, unless otherwise required by law.

If any part of this dispute resolution section is found unenforceable, the remaining provisions will continue to apply. If the class action waiver is found unenforceable for a particular claim, that claim must be litigated in court and arbitration will not apply to that claim.
